Terms of Service and SMS Program Terms

These Terms of Service and SMS Program Terms ("Terms") govern use of the 1 and Done Exam Prep website, browser app, and Daily Text Prep SMS program (collectively, the "Service"). 1 and Done Exam Prep and 1anddone-examprep.com are service and brand properties of TCG Global Enterprises, Inc. ("TCG Global Enterprises, Inc.," "we," "us," or "our").

1. Educational service only

1 and Done Exam Prep provides mobile-friendly study tools for supported professional examinations, including LMFT, LCSW, NCMHCE, EPPP, and PMHNP. Content availability differs by exam and is identified in the account and product interface. The Service is for educational study support only. It is not psychotherapy, clinical supervision, legal advice, licensing advice, crisis support, or a guarantee that you will pass an examination or receive a license.

2. Eligibility and responsible use

The Service is intended for adults preparing for professional licensure or related study. You are responsible for using the Service lawfully, maintaining the security of your device, and entering accurate information. Do not submit protected health information, client names, clinical records, emergency disclosures, payment card data, passwords, or other sensitive information through the Service or by text message.

3. Daily Text Prep SMS program

Daily Text Prep is an optional recurring text-message study program. After you sign up, the program may send original exam-prep questions, answer feedback, study tips, scheduling notices, account notices, and support responses.

4. No emergency or clinical monitoring

The Service is not monitored as a crisis, emergency, therapy, or supervision channel. Do not use the Service for urgent mental-health, safety, legal, or clinical matters. If you or someone else may be in danger, contact local emergency services or an appropriate crisis resource immediately.

5. Examination organizations and content availability

The Service uses original practice content designed around public examination competencies and published examination information. 1 and Done is independent and is not affiliated with, sponsored by, or endorsed by AMFTRB, ASWB, NBCC, ASPPB, ANCC, or any licensing board. It does not provide live, recalled, copied, or proprietary examination items. Selecting an examination in an account does not mean its question bank is already available; coming-soon examinations cannot be purchased until a published content blueprint is available.

6. Accounts, progress, and local storage

The browser app may store study progress locally on your device. Daily Text Prep stores server-side records needed to schedule texts, process replies, document consent, and show optional text-study receipts. If you clear browser storage, change devices, or sign up by scanning a QR code from another phone, some browser-based progress or receipt features may not be available on the original device.

7. Intellectual property

The Service, including questions, rationales, study tips, graphics, software, page designs, and other content, is owned by TCG Global Enterprises, Inc. or its licensors. You receive a limited, personal, nonexclusive, nontransferable right to use the Service for individual study. You may not copy, scrape, publish, resell, redistribute, or build competing question banks or services from the content.

8. Acceptable use

You may not interfere with the Service, attempt unauthorized access, misuse APIs, reverse engineer protected systems, submit unlawful or harmful content, use the Service to violate another person's privacy, or use automated tools to harvest content or messages.

9. Third-party providers and carriers

The Service may rely on providers such as Vercel for hosting and scheduled functions, Supabase for database services, Twilio for messaging, wireless carriers for SMS routing, and QR-code tooling for signup access. These third parties may process information as described in the Privacy Notice and under their own terms.

10. Availability and changes

We may modify, suspend, or discontinue all or part of the Service at any time. Delivery may be affected by carrier filtering, sender registration, unsupported destinations, device settings, network outages, incorrect phone numbers, or legal restrictions. We may update these Terms by posting a revised version with a new effective date.

11. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, TCG Global Enterprises, Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, and noninfringement. Study outcomes and licensing results depend on many factors outside the Service.

12. Limitation of liability

To the fullest extent permitted by law, TCG Global Enterprises, Inc. will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages; lost profits; loss of data; carrier charges; delivery failures; examination or licensing outcomes; or damages arising from misuse of the Service. Some jurisdictions do not allow certain limitations, so some limits may not apply to you.

13. Termination

We may suspend or terminate access if we believe you violated these Terms, created risk for the Service, infringed intellectual property rights, or used the Service unlawfully. You may stop SMS participation at any time by replying STOP.

14. Payment, plans, refunds, and access extensions

Access to the 1 and Done study toolkit is offered through fixed-term plans (The Blitz, The Sprint, The Jog, and The Marathon). When offered for The Jog or The Marathon, monthly payment installments are a billing convenience for the same fixed-term access plan. They are not an automatically renewing plan.

14.1 Supported examination and controlling terms

The retake benefit applies only to the supported licensing examination selected at checkout: LMFT, LCSW, NCMHCE, EPPP, or PMHNP. The selected examination, benefit percentage, dollar cap, and terms version are recorded with the purchase. The purchase is linked to a verified account after checkout using the verified checkout email. Fee and cap amounts may change for future purchases, but a completed purchase remains governed by the terms version and cap accepted at that checkout.

14.2 Eligibility and deadlines

To qualify, the purchaser and examinee must be the same person. The pay-in-full Jog or Marathon purchase must be successfully paid and must not have been refunded, disputed, or charged back. The claimant must open the claim through the verified purchasing account no later than 30 calendar days after the official unsuccessful score report was issued. The claimant must register and pay for a subsequent attempt of the same selected examination no later than 30 calendar days after the unsuccessful attempt. Reimbursement is not due until TCG Global Enterprises, Inc. verifies the subsequent retake payment.

The claimant does not need active study access when taking the examination, filing the claim, paying for the retake, or receiving reimbursement. The account must, however, contain qualifying paid-program study receipts. At least one qualifying event must have occurred within two calendar months before the unsuccessful attempt for The Jog or four calendar months before the unsuccessful attempt for The Marathon.

14.3 Study receipts

Qualifying receipts are validated server records of scored paid-bank questions, completed adaptive-practice blocks, submitted mock examinations, branching-case decisions, or completed paid Daily Text Prep questions. Logins, page views, free-preview answers, self-reported study check-ins, delivery of an unanswered message, administrator-created events, automated activity, and manipulated activity do not qualify. The qualifying receipt snapshot is preserved when the claim is submitted.

14.4 Required documents

The claimant must upload a complete official score report showing the claimant's identity, supported examination, unsuccessful result, and examination or report date, plus an itemized receipt or official payment confirmation showing the claimant's payment for the subsequent attempt. TCG Global Enterprises, Inc. may request additional information reasonably necessary to verify identity, examination, dates, payment, eligibility, or document authenticity. Documents are submitted through the private claim workflow and must not contain unrelated client or patient information.

14.5 Benefit calculation and limits

The Jog benefit is the lesser of 50% of the verified eligible registration fee or $350. The Marathon benefit is the lesser of 100% of that fee or $650. Only the amount actually paid by the claimant for the core supported examination registration fee is eligible. Each qualifying pay-in-full purchase provides no more than one reimbursement for one retake. The benefit cannot be stacked or combined across plans, purchases, accounts, promotions, employers, schools, insurers, grants, or other reimbursement sources, and it cannot exceed the claimant's unreimbursed expense.

14.6 Exclusions

The benefit does not cover an initial examination attempt; practice examinations; study products; tutoring; licensing-board applications; eligibility or approval-code charges; score transfers; hand scoring; rescheduling, transfer, cancellation, late, or no-show charges; travel; lodging; meals; childcare; lost wages; taxes; financing costs; or any fee other than the core registration fee for the supported examination selected at purchase. Claims may be denied for missed deadlines, incomplete or unverifiable documents, identity or examination mismatch, duplication, alteration, fraud, unauthorized payment credentials, account sharing, manipulated or automated activity, prohibited examination content, violation of program or examination rules, refunded or disputed purchases, or amounts already reimbursed by another party.

14.7 Review, payment, and reconsideration

Authorized staff review each claim; submission does not constitute approval. Approved reimbursement is paid outside the study application after payment verification, and the application records the amount, method, date, and external reference. Normal benefit administration ends 12 months after the purchase date. A later request may receive discretionary case-by-case reconsideration only when the claimant documents at least two unsuccessful attempts. Reconsideration may excuse timing requirements but does not increase the percentage, dollar cap, or one-retake limit and does not establish a right or precedent for another claimant.

15. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to these Terms or the Service will be the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction there. Nothing in this section limits any rights you have under applicable consumer-protection laws that cannot be waived.
